GTA Swim School Terms and Conditions

These Terms of Use (“Terms”) govern your access to and use of the website located at www.gtaswimschool.ca (the “Site”) and any related services provided by GTA Swim School Inc. (“GTA Swim School”, “we”, “us”, or “our”), including swim lesson bookings, communications, and related offerings (collectively, the “Services”).

By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, you must not use the Site or Services.

1. Eligibility and Authority

You must be the age of majority in your province or territory of residence to use the Services. If you are booking lessons for a minor, you represent and warrant that you are the parent or legal guardian and have the authority to agree to these Terms on their behalf.

2. Description of Services

GTA Swim School provides private and small-group swim instruction and related services. Services may be provided at private residences, condominium pools, or other agreed-upon locations.

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without liability.

3. Account Registration

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your information
  • Keep your login credentials confidential
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Booking, Payment and Cancellation

All lesson bookings are subject to availability and acceptance.

By booking a lesson, you agree to:

  • Pay all applicable fees and taxes
  • Provide valid payment information
  • Comply with our cancellation and rescheduling policy

Specific cancellation timelines and refund eligibility will be outlined in our separate Cancellation Policy, which forms part of these Terms.

Failure to comply with booking policies may result in forfeiture of lesson fees.

5. Health and Safety

You acknowledge that swimming and aquatic activities involve inherent risks, including risk of injury, illness, or death.

By using our Services, you:

  • Confirm that participants are physically able to participate in swim lessons
  • Agree to disclose any medical conditions or limitations
  • Agree to follow all safety instructions provided by instructors

Participation may require signing a separate Liability Waiver.

6. Acceptable Use of the Site

You agree not to:

  • Use the Site for unlawful purposes
  • Interfere with the security or functionality of the Site
  • Attempt unauthorized access to systems or data
  • Upload malicious code or harmful content
  • Misrepresent your identity

We reserve the right to restrict or terminate access for violations.

7. Intellectual Property

All content on the Site, including text, graphics, logos, branding, designs, images, videos, and software (the “Content”), is owned by or licensed to GTA Swim School and protected under Canadian copyright, trademark, and intellectual property laws.

You may not copy, reproduce, distribute, modify, or exploit any Content without prior written consent.

“GTA Swim School” and associated logos are trademarks of GTA Swim School Inc. and may not be used without permission.

8. User Content

If you submit reviews, testimonials, images, or other materials (“User Content”), you grant GTA Swim School a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, publish, and distribute such content for marketing and operational purposes.

You represent that you have the legal right to submit such content.

9. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content, privacy practices, or terms of third-party sites.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA).

11. Disclaimer of Warranties

The Site and Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, GTA Swim School disclaims all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of information

We do not guarantee uninterrupted or error-free access to the Site.

12. Limitation of Liability

To the maximum extent permitted by applicable Canadian law:

GTA Swim School, its directors, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services.

Our total liability for any claim shall not exceed the total amount paid by you to GTA Swim School in the twelve (12) months preceding the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.

13. Indemnification

You agree to indemnify and hold harmless GTA Swim School and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising out of:

  • Your use of the Services
  • Your breach of these Terms
  • Your violation of applicable laws

14. Termination

We may suspend or terminate your access to the Site or Services at our discretion, including for breach of these Terms.

Termination does not relieve you of outstanding payment obligations.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be resolved exclusively in the courts located in Ontario, Canada.

16. Force Majeure

GTA Swim School is not liable for failure or delay in performance resulting from events beyond our reasonable control, including natural disasters, public health emergencies, government actions, labour disputes, or power/internet outages.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

19. Entire Agreement

These Terms, together with any referenced policies (including Privacy Policy and Cancellation Policy), constitute the entire agreement between you and GTA Swim School regarding use of the Site and Services.

20. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date.

Continued use of the Site constitutes acceptance of the revised Terms.
